TERMS
AND CONDTIONS AND PRIVACY POLICY
Booking
Conditions, please read these, they are important!
Please read these conditions carefully as they are the terms
of your contract with us.
Agreed bookings will not be confirmed until full deposit
of half your room charge has been received in advance. Dates
enquired of will only be held open for seven days pending
receipt of deposit. The deposit will be refunded in full
if you cancel more than eight weeks in advance of your holiday.
All prices are quoted in Euros. The full balance is payable
at the end of your stay including any extras, such as meals,
drinks, telephone calls or internet costs and any other
services given.
Cancellations
Once a booking has been confirmed you are contracted to
pay the full balance due as described above. If you wish
to cancel the holiday outside the eight-week period we will
attempt to re-let the accommodation, if successful, and
at our discretion, refund all or part of the deposit paid.
You must appreciate that the shorter the notice, the less
likely we will be able to re-let the accommodation. You
are strongly advised to take out travel insurance, which
covers any financial loss resulting from unavoidable cancellation.
Accommodation
Rooms at Maison De L'Orb are available for occupancy from
12 pm on the date of arrival and must be vacated by 11.00am
on the date of departure. This allows us time to prepare
for each arrival. You are expected to leave the accommodation
in a clean and tidy state and to leave the room and its
contents as you found it, any breakages/equipment failure
must be brought to our attention at the time. We reserve
the right to make reasonable deductions when appropriate.
The deposit (whole or part) will be deducted from your final
bill at check out on the day of departure. In general, for
clients staying for a week or more, bedding and towels are
changed weekly. All rooms are equipped with toiletries and
towels.
All areas including bedrooms and the gites are non-smoking,
as is the Dining Room. Any bedrooms suffering from residual
tobacco odours will be specially cleaned and aired over
a 24-hour period and all charges resulting from this, both
actual and loss of business (at prevailing B&B rates)
will be charged to the credit card given to secure the booking.
Smoking is permitted in the garden area and would ask that
you also place unused cigarette ends and ash to ashtrays
provided for smokers
We will not be liable for any matters beyond the reasonable
control of ourselves; nor for any loss, damage or inconvenience
caused to or suffered by any guest should the property be
destroyed or substantially damaged prior to the booked period,
other than the amount already paid by you in respect of
the booked period. Under no circumstances shall our liability
to you exceed the amount paid to us by you for the booked
period. The use of the accommodation, grounds, equipment
or other amenities is entirely at your risk and we accept
no responsibility for any injury, loss or damage to guests
personally, their belongings or vehicles. You are reminded
to bring form E111 (healthcare cover) with you and to have
provided your own travel/holiday insurance cover, or any
other type as protection excluding us from any such liability
of any kind at all.
Reservation Process
All
enquiries and reservations are made through our agents or
alike and our website should be sent a confirmation booking
email to confirm their booking and dates etc. Our aim is
to make your life simpler by handling all of the reservation
correspondence with the French and English hosts on your
behalf. Visitors who are planning a multi-location trip
to France in particular benefit from our service as we are
able to make other bookings for them and may incur a small
fee for doing so.
Payment
A
deposit of 50% of the booking value will be required on
your confirmation of the reservation if the date of arrival
at your first accommodation is more than six weeks from
the date of reservation. This deposit is non-refundable.
Otherwise, payment in full is required. Payment in full
will also be required at the time of booking if the reservation
value is 100€ or less. If payment of the deposit or
of the full amount (as applicable) is not received by the
Maison De L'Orb within five working days of the client completing
the payment form, due to incorrect credit/debit card details
being provided, the reservation will be deemed void and
the host will be free to accept alternative reservations
and could have to pay any administration costs.
Payment
can be made by credit card (Visa or MasterCard), by Paypal
or by cheque (Euros or Sterling) and sent to our address
on our website. For payments by credit card, a surcharge
of 2% will be applied to the booking value and a surcharge
of 4% for any Paypal transactions.

All reservations processed through us directly or through
our website and its agents form a contract only between
Maison De L'Orb (Qualitiwork Limited) and the guest. This
contract is NOT between the agents and the guest. This contract
is deemed valid from the time a confirmation of reservation
email is sent to the guest's email account given on the
enquiry form unless the email is returned to our email directly,
the email is deemed to have been received by guest.

Maison De L'Orb warrants that it will process reservation
requests in accordance with accepted industry and confirm
any such reservations in advance. Maison De L'Orb and its
associated agents accept limited liability for any loss
due to an error by the staff of Maison De L'Orb. Liability
is limited to the accommodation cost of the establishment
concerned.
Maison De L'Orb is not liable for any of the following conditions:
Confirmation
email sent to guest is not received.
The
accommodation cancels guest's rooms due to late arrival
of guest.
The
accommodation cancels a reservation due to circumstances
outside the control of Maison De L'Orb
.
Guest enters incorrect details on enquiry form.

On receipt of the deposit/full payment and of the host's
acceptance of your reservation, guests will be emailed with
full details of their booking, which will include the address
details of the accommodation , directions on how to find
them and other information such as check-in times, local
taxes that may be payable etc. Please note that information
such as check-in times is provided for guidance only - we
cannot be held responsible if hosts in France are not able
to maintain the times stipulated for whatever reason. (Please
remember that France is 1 hour ahead of the UK)

If the deposit was paid by visa or by debit card, the balance
(if applicable) will be automatically debited to the guest's
card six weeks prior to the arrival date, although we will
give 24 hours notice by e-mail that the payment will be
taken. If for whatever reason the balance is not forthcoming
within seven working days from the due date, Maison De L'Orb
will consider the reservation cancelled and the deposit
will be forfeited.
Please
note that if you request any amendments to your reservation
after the deposit has been paid (amendments may include
changes to dates, changes to the number of nights, changes
to the number of persons in the party etc), an administration
fee of 20€ will be charged.
Cancellation
If
you cancel a confirmed booking, the following penalties
apply - Cancellation received by us 14 days or less before
the first night booked (this is the first date on your itinerary
and not individual stops) - No refund is guaranteed. However
if the host is able to re let the rooms then a refund will
be at their discretion. You may be able to negotiate the
refund on your booking at the discretion or our agents and
staff at the then time.
Cancellation
received between 15 days and 28 days before first night
booked - 50% refund of the value paid plus an admin fee
of 25€.
Cancellation
received between 29 days and 42 days before first night
booked - 75% refund of the value paid plus an admin fee
of 45€
The
deposit is non-refundable
Cancellation
or changes to your accommodation made by us or our agents;
In the unlikely event that we are forced to cancel or change
your accommodation booking, we will notify you as soon as
possible and seek to arrange alternative accommodation of
equivalent quality and in the same general location. We
regret no refund or compensation will be payable if we have
to cancel your reservation due to circumstances that we
could not reasonably foresee or avoid. These may include
war, threat of war, civil strife, industrial action, terrorist
activity, natural or nuclear disaster, fire, bad weather.
In these circumstances, we are not liable and we will not
pay any resulting expenses or additional costs. In all cases
liability and compensation are restricted in accordance
with the provisions of all applicable international conventions
which concern accommodation
Legalities
Location
of business - Qualitiwork Ltd (www.maisondelorb.com) (The
Company) is a business registered in England (Company registration
number 03309751) whose registered office is at 27 Old Gloucester
Street, London WC1N 3XX, England, and is therefore governed
by English law. This is applicable to anybody who can view
the website in any other country, and / or has contact with
The Company by any other means of communication such as
electronic mail, fax or post, without necessarily having
viewed the website (www.maisondelorb.com).
Your
contract with The Company is based on these booking conditions,
which are governed by English law and English courts. Your
statutory rights are not affected by anything in these booking
conditions.
Complaints Procedure
The
Company acts as a booking agent only and the information
supplied in our pages has been supplied directly by our
hosts. We cannot therefore be held responsible for any inaccuracies
in the information provided. In particular, you should note
that tariffs are subject to change without notice. We accept
liability if the accommodation is not of a reasonable standard
within the context of the price of the accommodation and
the length of your stay.
If
you have a complaint about the accommodation we have arranged,
you must tell the staff of the accommodation immediately
at the time of your stay or speak to the duty manager. If
they do not put things right and your enjoyment of your
stay is severely affected you must let us know as soon as
possible, but in any case within 48 hours of the problem
becoming apparent. You can contact us by phone from the

We need your name, where you can be contacted and full details
of the problem. If, having returned to the UK, you wish
to take the matter further, you must write to us with full
details of the complaint within 28 days of your return.
We will not be responsible for complaints made after this
time or if you have not followed the above procedure. We
endeavour to respond to all complaints within five working
days.
We
will compensate you in the following situations;
In
the case of damage other than death, illness or personal
injury, compensation shall be limited to a reasonable amount
having regard to such factors as, among others, the accommodation
cost, the length of your stay and the extent to which it
can be shown that your holiday enjoyment has been affected.
We will not be responsible for your disappointment because
of your unrealistic expectations where the accommodation
has been as described.
We
accept liability if you suffer death or personal injury
as a result of the accommodation not being as described
and not of a reasonable standard.
These
acceptances of liability do not apply if there has been
no fault on our part nor on the part of the accommodation
owners, and the loss, death or personal injury suffered
is attributable to your own acts or omissions, or to the
acts or omissions of a third party not involved in the provision
of the accommodation. Nor does the acceptance of liability
apply if your death, injury or illness is caused by an event
whose consequences could not have been avoided or anticipated
even exercising all due care, or to an event which, even
exercising all due care, could not have been foreseen or
forestalled. They are also conditional upon you assigning
to us any rights you might have against any other persons
whose acts or omissions give rise to our liability. In all
cases, liability and compensation are restricted in accordance
with the provisions of all applicable international conventions,
which concern accommodation.
Please
note that it is the responsibility of any traveller overseas
to ensure that they have adequate travel insurance for their
trip. This also includes any such medical and hospitalisation
where necessary, and if you are unable to leave your room
for any medical reason, your insurance must be able to cover
all costs relating to the ongoing room charges etc. You
will be billed until such alternative arrangements have
been made.
Special
dietary requirements
We
regret that we are not able to accommodate any person(s)
with a serious and/or life-threatening nut or food allergy,
as we cannot guarantee the provenance of every item of food
in our kitchen. We are happy to cater for any other dietary
needs, such as gluten-free, vegetarian or vegan diets, but
please tell us at the time of booking as we can provide
more interesting choices with prior notice
Single
occupancy
Midweek and low season sole occupancy is charged at the
normal room rate less 20%. Special arrangements made will
be made and agreed in writing beforehand. For the months
from June to August or any other peak times such as Christmas
or main public holidays in France, the room prices will
be at the maximum cost levels. For single occupancy, there
may be some discounts available but not necessarily in peak
times, but you should see our web site for any such prices
and discounts in any event.
There may be additional costs and charges that if agreed
beforehand or at the time of usage, then you shall become
liable upon receipt of all services acquired. These costs
shall include items such as - Evening meals, Drinks, events
or special events or outings, Telephone calls and internet
services, car or bike hire, or meals and events outside
or the main house arranged beforehand. Any person leaving
before the agreed term of your stay shall still be liable
for the remaining nights stay, plus any such services used
and still using to date.
Any payments made by card or otherwise, and found to be
fraudulent shall be reported to the police and authorities
in both France and the UK and we could seek any compensation
through the courts and collections agents to resolution
and recompense in its full and final settlement. This could
also result in criminal action taken in respect of any of
this or any such criminal damage to the rooms or items throughout
the house, if left in a damaged state. This also includes
stolen goods from the house and rooms alike.
Dogs
We welcome dogs in the gites but not in the guesthouse accommodation,
provided they do not run amok, bite or bark and that they
use the doggie towels (provided) to wipe their dirty paws.
Dogs are welcomed with a bag of special biscuits and are
charged at 20€ per stay, with a maximum of two dogs
per gite. Please note we have three dogs in resident.
Children
We welcome children nine years old and over, to stay in
the gites but not in the main house accommodation. Cot hire
and bedding is charged at 30€ per stay.
Damage
We reserve the right to charge for the replacement, cleaning
or repair of any item(s) belonging to the guest house, or
the fabric of the guest house itself, damaged either wilfully
or because reasonable precautions have not been taken. In
the event your credit card will charged without prior consent
being required against invoice(s) that will be provided
for the costs incurred.
Security and Data
The
on-line credit card booking facility is built with the greatest
security in mind that helps prevent any kind of fraud or
data theft of any kind. We do not share your data or information
with any other third party organisation for sales or any
other. We hold our clients details for our own and future
marketing and statistical purposes only.
Privacy
The
Company is committed to protecting your privacy. We will
only use the information that we collect about you lawfully
(in accordance with the Data Protection Act 1998). We collect
information about you for two reasons: firstly, to process
your booking and second, to provide you with the best possible
service. We will not e-mail you in the future unless you
have given us your consent. We will not pass your e-mail
address to any other trusted traders. The person responsible
for privacy is Mr M Binmore who can be contacted on email

The
type of information that Maison De L'Orb will collect about
you will come from the enquiry form and payment form that
you may complete on our website and includes your name,
address, telephone number, email address and credit/debit
card details
We
will never collect sensitive information about you without
your explicit consent. The information we hold will be accurate
and up to date. You can check the information that we hold
about you by emailing us. If you find any inaccuracies,
we will delete or correct it promptly. The personal information
that we hold will be held securely in accordance with our
internal security policy and the law.
If
we intend to transfer your information outside the EEA (European
Economic Area), we will always obtain your consent first.
We use technology to enable on-line reservations & to
track the patterns of behaviour of visitors to our site.
This includes using a "cookie" which would be
stored on your browser. You can usually modify your browser
to prevent this happening, although if you do this you will
not be able to use the on-line booking procedure. The information
collected in this way can be used to identify you unless
you modify your browser settings. Further, Maison de L'Orb
will never send you unsolicited email or other correspondence.
Only those people who opt in to our mailing list using the
'register' link will receive mailings and other information
that we feel may be of interest.
